California rapper Shawn Thomas, who records as C-Bo, appears to be the first
musician arrested for what he said on a record.
Thomas was taken from his home to Sacramento County Jail on Tuesday afternoon
after the state decided his latest album, "Til My Casket Drops," violates the
terms of his parole.
Though music is not mentioned specifically, Thomas' parole agreement does
stipulate that he "will not engage in any behavior which promotes the gang
lifestyle, criminal behavior and/or violence against law enforcement." His
parole also restricts him from associating with gang members.
"There are 17 songs on the album, and each one promotes the gang lifestyle,
criminal behavior and violence against law-enforcement officers, public
officials and parole agents," said Tipton Kindel, assistant director of
communications for the California Department of Corrections.
The most incendiary track on the album, which was released Feb. 23, is "Deadly
Game." In an interview three days before his arrest, Thomas said he and the
rapper X-Raided wrote the song in 1995 because of his belief that a California
law targeting repeat criminals has spiraled out of control. Under a "three
strikes, you're out" provision, conviction for a relatively minor violation
like shoplifting can lead to a life sentence.
The song features provocative lyrics about killing a police officer in order
to avoid being arrested for what would be a third-strike offense:
"You better swing batter, batter swing/'Cause once you get your third felony,
it's 50 years you gotta bring/It's a deadly game of baseball/So when they try
to pull you over, shoot 'em in his face, y'all."
Such words did not escape the attention of the law.
"After reviewing the lyrics and the entire file," Kindel said, "it was
considered that he was actually more of a danger to leave on the street, so it
was decided to arrest him."
Thomas' supporters say this type of restriction violates the rapper's 1st
Amendment rights.
"I don't think that it's fair," said his wife, Sandra. "Everyone is entitled
to their 1st Amendment rights. In prison he had more freedom than he has on
the streets."
The Sacramento rapper was arrested after a 1993 video shoot, when, Thomas
said, he fired shots in the air to quell a potential gang situation. But
instead of dispersing the crowd, the gunshot confused and excited those in
attendance, resulting in a fatal shooting.
Though Thomas, 26, was not charged in the death, he subsequently was convicted
of illegally discharging a firearm and sentenced to probation. After violating
his probation by being arrested in Cincinnati for marijuana possession, Thomas
was given a two-year sentence. He was released from prison in June after
serving 15 months.
"When it comes to a parolee, we have the responsibility to try to keep them
from participating in the behavior that got them into trouble," said
California parole administrator Henry Peralta.
Ann Brick, a staff attorney for the American Civil Liberties Union of Northern
California, counters that parole conditions should not restrict speech.
"It is extremely unusual and very disturbing," she said. "He's not being
punished for anything he did. He is being punished for using music as a means
of expressing his political views. The state is trying to put him back in jail
because they don't like what he said."
Thomas has been recording rap music for several years. His first album, "The
Autopsy," was released in 1994, and he has released five records since then.
All six feature violent story lines.
Although Thomas, whose moniker is an abbreviation of "Cowboy," records for the
tiny Sacramento label Awol, he has developed a loyal fan base and respect from
his musical peers. Thomas was a featured artist on Tupac Shakur's huge "All
Eyez On Me" album, and San Francisco-area rap legends E-40 and Spice 1 are
among the multitude of guests who appear on "Til My Casket Drops."
Thomas will be held in the county jail, with the possibility of being
transferred to prison, until the California Board of Prison Terms sets a
hearing date for the case, which may take up to 45 days. At the hearing, the
board will decide whether Thomas violated his parole and, if so, determine an
appropriate penalty. Thomas could serve up to an additional 12 months in
prison.
"This is the parole board getting into the content of his music," said John R.
Duree Jr., one of the lawyers representing Thomas. "His music has a political
message, and it's a political message that they don't like. When they say your
music can't be anti-law enforcement, they say, `We don't like those politics.'
Words aren't considered dangerous in our constitutional system."
Before the album was released, his lawyers filed three appeals, the maximum
allowed, to the corrections department objecting to the terms of parole. Each
was denied.
"They're trying to take my freedom of speech -- telling me what I can't say
and what I cannot do," Thomas said Saturday.
He also said some of the material was recorded before his arrest and that he
now better understands his status as a role model in the community.
"Right now, it's getting to the point where what I say is more important" than
it used to be, Thomas said. "It's not just talking about being in the 'hood,
pulling out guns and doing a driveby. I lived that lifestyle. Now my lifestyle
is all about Rolex chains, diamonds, convertible Benzes. I changed. As I
change, my lyrics will change. I'm not gangbanging anymore, but I now I talk
about certain things that I might hear or something that happened to one of my
homeboys."
For example, on the song "Ride Til' We Die," the first track on the new album,
guest vocalist O Fed of the Mob Figgas says, "I'm never gang related, but
dedicated to my (brothers)."
Kindel said the Board of Prison Terms will take into consideration when the
lyrics were recorded and whether Thomas had control over the finished product.
Though Thomas has six albums to his name, "Til My Casket Drops" is the first
to be distributed nationally.
"The reason (the authorities) weren't paying attention to me at first (was)
because I was on an independent and they didn't feel I was going to expand out
there and have much power," said Thomas, whose new distributor is Noo Trybe.
"But now that this album's going nationwide, they think that I can just tell
everybody, `Let's go gangbang.' They feel like I'm back in that mentality,
which I am not."
Like most rappers, he says his work is simply an earnest reflection of his
environment. And even though he said he is no longer a member of a gang,
Thomas feels
he must continue to rap harsh rhymes in order to remain consistent with his
beliefs and to avoid alienating his audience. If he were to tone down his
lyrics too much, he said, he would have to build a new fan base.
This is not the first time rappers have had legal problems with their music.
In 1990, Florida record store clerks were arrested for selling 2 Live Crew's
"As Nasty As They Wanna Be" album, and members of the group were arrested for
obscene performances. The 2 Live Crew was acquitted of the obscenity charge in
a trial later that year.
Other, lesser-known rappers also have had conflicts over their artistic
expression. For example, Warner Bros. Records refused to release Kool G. Rap
and D.J. Polo's 1992 album "Live and Let Die" because the cover art and lyrics
were deemed too violent. The group was dropped from the label after refusing
to change either the cover photo or the album's content.
Before being arrested, Thomas said he would stand by his past output because
freedom of speech is not reserved only for the agreeable.
"This is a God-given talent that I have," Thomas said. "I chose to run with
it. I found out what my talent was. It was writing, expressing feelings. I
guess I'm getting so deep that they want to stop me. But I will never change.
All I'm doing is making rhymes -- stories and rhymes. I don't understand it."
